The Land Registry provides the legal evidence of title to land that has been registered in England & Wales at HM Land Registry.

Office copy of register and title plan

The office copy of register is a reproduction of the property title (the register) which is held at one of the district Land Registries and contains the same details as the land charge certificate in possession of the owner or mortgagee of the property.

 

The title plan is a copy of the filed plan held at one of the district Land Registries and is a detailed plan, showing the property location in relation to adjoining properties. Please note, the plan is not scaled and lacks the precision required for boundary disputes.

Index map search (Form 96)

An index map search is carried out to ascertain whether or not a property has been registered. If the property is registered, then the Title number will be provided. If however, the property is not registered then the index map search will reveal whether or not a caution against first registration affects the property, or if there is a pending application for registration.

Day list enquiry

The day list is a record of pending applications and official searches with priority. The day list enquiry will reveal details of outstanding searches and pending applications, if any exist. Where these do exist, application type, the priority date and time, the certificate number, the name of the applicant, the name and address of the person who has submitted the search or pending application and their reference will all be provided.

Matrimonial home rights (Form MH3)

The matrimonial home rights search is made following the Family Law Act 1996 to protect the rights of a spouse who has an interest in a registered matrimonial home, and whose name does not appear on the property register. The Land Registry will advise the other spouse (or former spouse) of the application and a note of the search is made on the register with a certificate sent to the applicant.

HMLR land charges – bankruptcy only (Form K16)

Unless a full search of the register (Form K15) has been made, a lender will require a bankruptcy search to be made in all transactions, whether the land is registered or unregistered. Until the lender receives a clear bankruptcy search they will not release the appropriate monies in respect of the transaction.
