If you are involved in buying property from a company you need
to be sure that there are no adverse issues that may affect the
transaction. This search will establish if there are any mortgages
or charges against the specific address being purchased.
When purchasing unregistered land from a company, undertaking a
company search will tell you if there are any fixed or floating
charges, or if a receiver or liquidator has been appointed.
Under the Land Registration Act 2002, a buyer is not bound by a
charge created by a company unless that charge is registered at
the Land Registry or otherwise protected on the register. However,
even in the case of registered land, a company search may still
reveal vital information. For example, you might learn of impending
insolvency or even that the company had been struck off the register
and therefore no longer exists in law.
